Can you build or repair a retaining wall on a Seattle ECA parcel?
Possibly, but you cannot rely on the ordinary four-foot no-permit condition when the parcel contains an environmentally critical area. SDCI also says retaining walls and rockeries are not eligible for the ECA small-project-waiver path, so the correct project-specific approval must be established before permanent construction is priced.
Use the City's map as a screening signal, then research the property and ask SDCI which path applies. A map flag is not a survey, a stability diagnosis, or a decision that construction is impossible.
Start with the three-condition permit test
Seattle's published no-construction-permit conditions for a retaining wall or rockery are cumulative. The structure must be four feet or lower when measured from the bottom of the footing—even when that footing is below grade—to the top; the parcel must not contain an ECA; and the work must not damage adjoining property or structures during or after construction. If any condition is not met, SDCI says a new construction permit is required.
Visible wall height is therefore not enough. A low wall on an ECA parcel, a wall at a property line, or demolition that needs temporary excavation or support can enter the permit path even when the exposed face looks minor. A construction permit is not necessarily the only approval. Soil movement can bring grading review; drainage connected to a side sewer requires a side sewer permit; and work or access in the public right-of-way can require separate review. Define the finished wall and all temporary disturbance before treating any permit answer as complete.
An ECA map is a screening tool, not a property diagnosis
Seattle's ECA program covers more than steep ground. Designations include landslide-prone, steep-slope erosion-hazard, liquefaction-prone, peat-settlement-prone, flood-prone, wetland, riparian, habitat, and abandoned-landfill areas. A parcel can intersect more than one designation, and the design question changes with the condition and the proposed disturbance.
SDCI says most mapped ECA information is advisory and that a detailed topographic survey or technical report may be needed to confirm conditions. It also warns that some critical areas may not appear on the map. Search the address in SDCI's Permit & Site History Research Tool, download the current Site Characteristics Report, and review related addresses, prior permits, plans, surveys, geotechnical reports, and drainage records. The finished wall face can sit outside a mapped polygon while its footing, excavation, equipment route, stockpile, anchors, drainage, or restoration enters an ECA or buffer.

What Seattle means by a steep slope and buffer
SDCI's steep-slope-relief page describes a steep slope as one that rises at least 10 feet over a horizontal distance of 25 feet or less. It says development is generally restricted in the steep-slope area and its buffer, which is typically 15 feet. Seattle Municipal Code section 25.09.090 addresses the buffer from the top and toe and allows the Director to require a greater or smaller buffer based on construction methods, disruption of topography and vegetation, and technical information about soils and hydrology.
Those dimensions are regulatory screening criteria, not a do-it-yourself stability test. A phone slope reading cannot establish the regulated boundary, whether a slope resulted from earlier lawful grading, or whether a proposed excavation can be performed safely. Ask what documentation SDCI requires for the actual proposal rather than trying to approve the site from a map and one measurement.
Choose the exact ECA path—terms are not interchangeable
Homeowners often use “exemption” for any decision that permits work on an ECA property. Seattle separates exemptions, steep-slope development relief, modifications to submittal requirements, small project waivers, variances, and other land-use decisions. They answer different questions and should not be combined into one contractor allowance.
Ask the permitting lead to name the requested decision, applicable code criterion, supporting documents, fee responsibility, schedule assumption, and the permit application that follows it. Relief or a modified submittal does not erase the ECA, approve an undefined wall, or remove other drainage, grading, tree, shoreline, or right-of-way requirements.

The four steep-slope development-relief categories
SDCI summarizes four situations in which it may allow development in a steep-slope area or buffer: work within the footprint of a lawfully constructed structure or paved area without increasing impact; a slope created by previous legal grading that was not steep beforehand; an isolated slope less than 20 feet in vertical rise and at least 30 feet from other steep-slope areas; or the minimum work necessary to stabilize an active landslide hazard.
These are application criteria, not boxes a homeowner can self-certify. SDCI says the request must be tied to a specific project and construction record. Supporting material can include a site plan, geotechnical report, topographic survey, historical street-grade profiles, and photographs, and most projects require a pre-application site visit. If relief is granted, the property remains an ECA site and the building or land-use permit still receives ECA review.
For active-hazard stabilization, separate immediate protection, minimum permanent stabilization, and elective improvements. Replacing a failed wall with a larger wall, new terrace, or expanded usable area can present a different proposal from the minimum work necessary to stabilize a hazard.
Prepare one site geometry for every discipline
SDCI's general permit guidance says many applications involving ground disturbance or added development on mapped steep-slope property require a Pre-Application Site Visit. The resulting preliminary assessment can identify ECAs, drainage patterns, trees, structures, street conditions, and possible property-line effects. It is not the final wall design.
Tip 103B, revised January 29, 2019, describes additional ECA site-plan information. A useful wall package should coordinate property boundaries and easements; existing and proposed contours; top and toe of slopes; ECA and buffer limits; wall face and footing; anchors or reinforcement; utilities; drainage; access and staging; excavation and temporary support; disturbance area and volume; affected vegetation; erosion control; restoration; and nearby structures that could be affected.
Do not commission unrelated sketches from each consultant. The survey, geotechnical scope, wall design, drainage plan, demolition sequence, and construction estimate should refer to the same geometry and disturbance limits. How current are the Tips and rules?
SDCI currently places a general warning on its Tips and Director's Rules pages: interim regulations implementing state legislation took effect in July 2025, and some guidance may not reflect the most current regulations or requirements. Tip 103B is dated January 29, 2019; Tip 327A is dated May 29, 2025. Their dates do not make them useless, but they make the current code, live project pages, and project-specific SDCI direction important checks.
The City is also conducting a 2026 ECA Code Update required by the Washington Growth Management Act; Seattle identifies 2017 as its last major ECA update. This article does not treat proposed amendments as adopted law. Until new provisions are adopted and effective for the project, verify the current Seattle Municipal Code, the project's vesting and permit record, and SDCI instructions. Recheck the linked update page before relying on this guide for a later project.
When checked, Municode's online Seattle code was Supplement 44, Update 1, updated July 15, 2026 and codified through Ordinance 127423. Municode also warns that adopted ordinances can await codification, so the version statement is a research timestamp rather than a guarantee that no later legislation applies.
Rainy-season work: check both the site and the permit record
SDCI's standing grading-season page says an extension is needed to grade or disturb soil from November 1 through March 31 in a landslide-prone area, including a steep slope, known slide area, or potential slide area. It also identifies a separate trigger where SDCI restricted rainy-season grading as a permit condition, often on projects with substantial grading. That page directs applicants to look for “Monitor Seasonal Grading” in the special-inspection authorization letter.
SDCI's dated September 1, 2026 notice describes the operational check differently. It tells projects requiring geotechnical special inspections that are in an ECA or involve significant earth-moving to check the special-inspection permit record for “Monitor Grading Season Restriction.” It also notes that some smaller ECA projects may instead have approved-plan measures for wet-weather work. Use the exact issued record for the project; do not transfer an exception or label from another permit.
The two official pages also give different opening dates. The standing page says applications are accepted on or after October 1 each year, while the 2026 notice says acceptance begins September 15, 2026. For 2026, follow the dated notice and current Seattle Services Portal instructions; for later years, check the notice for that year rather than copying either date. Both sources state a review target or possible review time of about two weeks, and the permit must be issued before the extension can be processed.
The standing page says the application charge covers one hour of review and additional time is billed at the current hourly rate. Private survey, geotechnical, structural, drainage, and construction costs are not fixed by that City fee. Drainage must end at an approved, maintainable destination
A layer flag does not create one universal drain detail. Separate uphill surface water, water collected behind the wall, groundwater encountered during excavation, temporary dewatering, and the permanent discharge route. Moving water away from the wall but onto a slope, neighbor's parcel, sidewalk, or unapproved outlet can relocate the problem rather than solve it.
SDCI says a side sewer permit is required when drainage installed behind a wall connects to a side sewer and points to the subsurface-drainage provisions in active Director's Rule 4-2011. If movement is active, stop routine bid collection
A gradually leaning wall is not automatically an emergency, but active soil movement, falling material, a broken utility, damage to an occupied building, or danger to a public area needs a safety response before a normal estimate. Stay out of unstable or undermined areas, keep other people away, and call 9-1-1 when life or safety may be threatened. SDCI's emergency-management guidance says to leave the premises and call 9-1-1 when a landslide damages property.
Seattle has an expedited Emergency Repair Permit for qualifying structural damage to a house or other building. That path does not mean every wall emergency qualifies, and temporary stabilization is not permission for undefined permanent work. Contact SDCI to identify the applicable record and keep emergency protection, investigation, permanent stabilization, drainage, and elective improvements as separate scopes.
A decision path before requesting retaining-wall bids
Screen for immediate danger
If movement is active, material is falling, a utility is broken, or people, a building, or a public area may be threatened, keep clear and use the emergency route before collecting routine bids.
Check the development-site record
Open the official SDCI property and permit history, Site Characteristics Report, and ECA map. Treat them as screening records, not a boundary survey or stability conclusion.
Define all disturbance
Show demolition, footing and wall, temporary excavation and support, access, stockpiles, utilities, reinforcement or anchors, drainage, erosion control, and restoration—not only the finished face.
Ask SDCI to identify the path
Confirm whether the proposal needs an exemption, steep-slope relief, modified submittal, variance or another land-use decision, PASV, construction or grading review, and separate drainage or right-of-way permits.
Coordinate survey and technical work
Make the survey, geotechnical investigation, structural design, drainage plan, construction sequence, and estimate answer the same site geometry and permit assumptions.
Resolve seasonal conditions
Check the issued permit and special-inspection record for rainy-season restrictions, use the current year's application notice, and assign wet-weather protection and shutdown responsibilities.
Compare one complete scope
Price the same approved basis, including temporary work, inspections, drainage endpoint, access, restoration, permit close-out, and response to differing field conditions.
Frequently asked questions
Does an ECA map flag mean the lot is unsafe?
No. It is regulatory screening information, not a parcel-level stability conclusion or forecast. SDCI says most mapped ECA layers are advisory, detailed information may be needed to confirm conditions, and some critical areas may not appear on the map.
Can a retaining wall under four feet avoid a permit on an ECA parcel?
Do not rely on height alone. Seattle's published no-permit test requires all three conditions, including that the parcel not contain an ECA. SDCI separately says a wall or rockery of any height on an ECA parcel must meet specific requirements or obtain the applicable exemption.

SDCI's September 1, 2026 notice says applications open September 15, while the standing page says October 1 each year. For 2026, use the dated notice and current portal instructions; for another year, check that year's notice. The permit must already be issued before SDCI can process the extension.
Define the site and approval path before pricing construction
Continue with the general permit test, decide who should lead the technical evaluation, and trace the drainage outlet before comparing contractor scopes. Service pages show selected permit evidence, not recommendations or project-specific approvals.
