The four-foot rule has three conditions

Seattle SDCI says a construction permit is not required only when all three conditions are satisfied: the rockery or retaining wall is four feet or lower, measured from the bottom of the footing—even when the footing is below grade—to the top of the wall; the wall is not on a parcel containing an environmentally critical area; and the work will not damage adjoining properties or structures during or after construction. If any one of those conditions is not met, SDCI says a new construction permit is required.

That measurement is not the height of the visible wall face. A homeowner who measures only from finished grade can miss the buried footing depth. The property-line condition also matters independently of height: SDCI gives a wall at the property line as an example where the potential for damage may trigger a permit. Permit status therefore cannot be decided from a photograph or a single exposed dimension.

  • Measure from the bottom of the footing to the top of the wall.
  • Check the parcel for mapped ECA conditions before relying on a height exemption.
  • Consider excavation, temporary support, and effects on adjoining property—not only the finished wall.
  • Ask SDCI for a project-specific answer when the conditions are uncertain.

A wall permit is not the only possible review

Excavation and fill can trigger grading requirements even when the wall itself appears small. SDCI lists thresholds involving vertical grade changes, soil volume, disturbed area, new hard surface, work near a street right-of-way, and work in or near environmentally critical areas. If grading is part of a construction-permit application, it may be reviewed as an element of that permit rather than as a separate application.

ECA rules are property- and proposal-specific. Seattle's ECA code covers geologic hazards such as steep slopes, landslide-prone areas, liquefaction-prone areas, and other critical conditions. SDCI states that a rockery or retaining wall of any height on an ECA parcel must meet specific requirements or obtain an applicable exemption. A neighborhood-level GIS summary cannot determine whether a particular wall is allowed; the official parcel map, the proposed disturbance, and SDCI review control.

Drainage can create another approval path. SDCI says a side sewer permit is needed when drainage installed behind a wall will connect to a side sewer. Work in the public right-of-way, or a private structure occupying it, can require separate Seattle Department of Transportation review. These questions should be resolved before bids are compared because they affect design responsibility, schedule, and scope.

Rockery is not just another name for retaining wall

Seattle's prescriptive rockery guidance treats a rockery as an erosion-control feature that relies partly on firm, stable native soil; it explicitly says rockeries are not considered retaining walls. Tip 321 supplies a prescriptive cross-section with limits and details including rock sizing, embedment, backward batter, drainage aggregate, a perforated drain to an approved discharge, and surface grading. A rockery outside those prescriptive conditions may require an engineered design.

This distinction matters when reading a proposal. A bid that says only ‘rock wall’ does not establish whether the design is a prescriptive rockery, an engineered rockery, or a structural retaining wall with a stone appearance. Ask the designer to identify the system, the governing detail, the retained height, and who is responsible for the professional stamp if one is required.

What to establish before requesting comparable bids

Collect the facts that change the regulatory and engineering question: approximate wall length; visible and total height if known; location relative to property lines, buildings, driveways, utilities, and the street; access for excavation; where soil will go; and where surface and subsurface water currently discharge. Photograph the wall and surrounding grade after rain without entering an unstable area.

Give each bidder the same information and ask for the same exclusions to be stated. A useful scope identifies who obtains the permit, who prepares structural or geotechnical documents, whether grading and side-sewer review are included, how adjoining property will be protected, how excavated soil and access restoration are handled, and which inspections or close-out documents are included.
